Filing Process
Good morning, everybody. Edward Kelley, your OKC bankruptcy attorney, here with part 3 in a 5-part series. Chapter 7, start to finish. All part of 3 minutes to financial freedom.
So, we talked about, we’re going to look at first, is your property exempt, protected? Meaning, do you get to keep your stuff? Then we’re going to look at, whether is your debt dischargeable. Can we get rid of it? If the answer is yes to those questions, then it’s time to pull the trigger.
Document Preparation
So, what’s the next step? Document preparation, collection, and filing. So, what’s wonderful about bankruptcy is it’s all e-file. But we have to show 6 months of your income, the previous 6 months prior to the month that we’re filing in. For example, if we’re going to file in July, we’ve got to show January 1st through the end of June, the previous 6 months.
We’ve got to get that from you. We’ve got to get 3 months at least of bank statements. We’ve got to get your last 2 years of taxes. We’ve got to get copies of your titles, you know, to show your assets. So, once we have all that, then we have the information we need.
Creating and Filing Documents
We go over with you and prepare all your bankruptcy schedules. Thankfully, we have some super-duper software to make that easier because we end up with, you know, 100 or more pages of documents to file. Then, we create those documents, scan them all into the computer, and e-file them directly with the relevant district bankruptcy court. We’ve got 3 in Oklahoma, Eastern, Northern, and Western. I practice in all 3.
So, once we have all those documents, we can file your case, and then we’re ready for the little creditor meeting, which we’ll talk about next time.
